All vehicle rentals are governed by a comprehensive Rental Agreement, which you will receive upon booking confirmation or at the time of vehicle collection. This agreement outlines the terms, conditions, insurance coverage, fees, and your obligations for the rental period. In cases of discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Renting a vehicle requires:
- To hire a vehicle from Car Hire Elgin, you must be at least 21 years old, although age restrictions may vary depending on the vehicle type. A valid full driving licence appropriate to the vehicle category is required, held for the duration specified in the Rental Agreement. Valid identification and proof of current address must also be provided, along with payment information and a security deposit. Additional requirements may be outlined in the Rental Agreement.
Booking and Payment Details
- Reservations can be made via our website, by telephone, or directly at our Elgin office. A deposit may be necessary to confirm your booking. Full payment and a security deposit are generally required upon vehicle pickup. All prices are quoted in British Pounds (£) and include VAT as applicable. We accept all major credit and debit cards, processed securely through trusted payment providers.
Vehicle Pickup and Drop-off
- At the time of vehicle collection, it is your responsibility to conduct a thorough inspection and report any pre-existing damage without delay. A vehicle condition report will be created and signed by both parties to document the state of the vehicle. Upon returning the vehicle, it should be in the same condition as when it was collected, considering only normal wear and tear. Any new damage identified will be evaluated and may incur additional charges. The vehicle must be returned with the same fuel level as received; otherwise, refueling fees will apply. Late returns can result in extra charges, so please notify us as soon as possible if you expect to return the vehicle later than agreed. You will be liable for any parking fines, traffic violations, or charges incurred during your rental period, along with an applicable administration fee.
Insurance and Liability Terms
- All rentals include basic third-party insurance. Comprehensive coverage information and excess amounts can be found in the Rental Agreement. Additional insurance options may be offered to limit your financial exposure. It is beneficial to review these options closely. You will be liable for damage or loss up to the excess amount, unless further insurance is purchased. Any damage resulting from negligence, misuse, or violation of these Terms remains your responsibility, irrespective of insurance coverage.
Cancellation and Modifications
Cancellation and amendment policies depend on the type of booking and the notice provided. For precise information, please review your booking confirmation or Rental Agreement. Late cancellations or failure to show up may incur additional fees.
7. Restricted Activities
Prohibited uses for your vehicle:
- The vehicle must not be used for any unlawful activities. Engaging in racing, rallying, off-roading, or any other dangerous pursuits is prohibited. Transporting hazardous materials is not allowed. Sub-letting the vehicle or permitting unauthorized drivers is forbidden. Driving under the influence of alcohol or drugs is strictly against policy. Additionally, do not exceed passenger or weight limits or operate the vehicle outside of the designated geographical boundaries without prior approval.
Breach of these terms may lead to rental cancellation and fees.
8. Liability Limitations
To the fullest extent allowed by English and Welsh law, Car Hire Elgin will not be responsible for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business, resulting from your use of our services. Our liability for any claims is limited to the rental amount paid in the previous 12 months. This limitation does not apply to liability for death or personal injury due to negligence or fraud.
9. Local Legal Framework
These Terms are governed by the laws of England and Wales. Any disputes will fall under the exclusive jurisdiction of the courts in this region.
10. Updates to Terms
We reserve the right to update these Terms at any time. Changes take effect immediately upon posting on our website. Continued use of our services indicates your acceptance of the revised Terms.
